Workers’ compensation is the exclusive remedy to an employee for work-related injury or sickness without regard to fault. When the injury arises in the course and scope of employment, then a worker has NO right to directly sue his or her employer. Instead, workers are entitled to an automatic monetary recovery through a workers’ compensation claim when the claim satisfies certain legal criteria.
